Welcome to KLWDS, a platform operated by LYVE (“Company,” “we,” “our,” or “us”). These Terms of Use (“Terms”) govern your access to and use of our platform, including our website, services, and associated applications (collectively, the “Platform”). By accessing or using the Platform, you agree to comply with and be bound by these Terms.

 

If you do not agree to these Terms, please discontinue your use of the Platform.

1. Eligibility to Use the Platform

To use KLWDS, you must:

  • Be at least 18 years old or the legal age of majority in Lebanon.
  • Be legally capable of entering into binding contracts.
  • Use the Platform only for lawful purposes in compliance with all applicable laws and regulations in Lebanon.

If you are using the Platform on behalf of a company or entity, you represent and warrant that you have the authority to bind that entity to these Terms.

2. Purpose of the Platform

KLWDS connects content creators, influencers, marketers, and brands in a professional marketplace. The Platform provides:

  • Tools for content creators to showcase their services.
  • A space for brands to post projects and collaborate with creators.

KLWDS aims to facilitate professional connections, but it is not directly involved in any agreements between users.

3. Account Registration and Responsibility

  1. Account Creation

To access certain features of the Platform, you must create an account and select a subscription plan. During registration, you agree to:

  • Provide accurate and up-to-date information.
  • Update your account details promptly if any changes occur.
  1. Account Security

You are responsible for:

  • Maintaining the confidentiality of your login credentials.
  • All activities occurring under your account, whether authorized or unauthorized.
  • Informing us immediately if you suspect unauthorized use of your account.

KLWDS reserves the right to suspend or terminate accounts that violate these Terms.

4. Subscription Plans and Payments

  1. KLWDS operates on a subscription-based model with no commission fees.

    1. Plans
    • Free Plan: Limited services or project postings.
    • Paid Plans: Expanded features and services based on the plan selected.
    1. Payments
    • Payments must be made in US dollars, as specified during the subscription process.
    • Payments are processed through secure, third-party payment providers.
    1. Refunds
    • Subscriptions are non-refundable unless required by Lebanese law or under exceptional circumstances at our discretion.

5. User Conduct and Responsibilities

  1. Prohibited Activities

You agree not to:

  1. Use the Platform for any unlawful, fraudulent, or malicious activities.
  2. Post or share content that:
    • Violates the rights of others, including intellectual property rights.
    • Is defamatory, obscene, or otherwise inappropriate.
    • Contains viruses, malware, or harmful code.
  3. Misrepresent your identity or qualifications.
  4. Collect personal data from other users without their consent.
  1. Local Compliance

As a user in Lebanon, you must comply with applicable laws, including:

  • Data protection laws.
  • Regulations related to freelancing, intellectual property, and e-commerce.

KLWDS reserves the right to remove any content or suspend accounts that breach these Terms or applicable laws.

6. Intellectual Property Rights

  • Your Content: You retain ownership of the content you upload or post on the Platform. By posting content, you grant KLWDS a worldwide, royalty-free license to use, display, and promote your content for Platform-related purposes.
  • Platform Ownership: All rights, titles, and interests in the Platform, including logos, trademarks, and software, remain the exclusive property of LYVE. Unauthorized use is strictly prohibited.

7. Liability and Disclaimers

  1. Platform Availability

The Platform is provided on an “as is” and “as available” basis. While we strive to maintain uninterrupted access, we do not guarantee error-free operation.

  1. Limitations of Liability

To the extent permitted by Lebanese law:

  • KLWDS is not liable for disputes, damages, or losses arising from user interactions.
  • KLWDS is not responsible for delays, errors, or service interruptions caused by factors beyond our control.

8. Termination of Services

  1. By the User

You may terminate your account at any time by contacting support. Upon termination, your account and data will be deleted within a reasonable timeframe, unless retention is required by law.

  1. By KLWDS

We reserve the right to suspend or terminate your account if:

  • You violate these Terms.
  • Your activities are deemed harmful to the Platform or other users.

9. Dispute Resolution

  1. Governing Law

These Terms are governed by the laws of Lebanon.

  1. Dispute Resolution Mechanism
  • Any disputes arising under these Terms will first be resolved through mediation.
  • If mediation fails, disputes will be subject to arbitration in Beirut, in accordance with Lebanese arbitration laws.

10. Privacy Policy

Your use of the Platform is subject to our Privacy Policy, which outlines how we collect, use, and protect your data in compliance with Lebanese data protection regulations.

11. Changes to These Terms

We may update these Terms from time to time. Changes will be communicated to users via email or through the Platform. Continued use of the Platform constitutes acceptance of the updated Terms.
